Terms of Service
These Terms are the contract between you and the company that publishes Stagyo. By creating an account, buying credits or using the service, you accept them. Please read them: they say what you are buying, what you may do with the images, and where each party's responsibility stops.
1. Who we are and who these Terms apply to
Stagyo is published by PropelSaaS Ltd, Private limited company (England & Wales), Companies House no. 17421667, whose registered office is at Office 20779, 182-184 High Street North, East Ham, London E6 2JA, United Kingdom (“we”, “us”). You can reach us at contact@stagyo.com.
Stagyo is designed for real-estate professionals — agencies, agents, developers, photographers and property managers — but individuals may also use it. When you use the service in the course of a trade, business or profession you are a business customer; otherwise you are a consumer. Some clauses below apply to only one of the two, and say so. Nothing in these Terms takes away rights that the law gives a consumer and that cannot be waived by contract.
If you accept these Terms on behalf of a company or an agency, you confirm that you have the authority to bind it, and “you” means that organisation. Every member you invite to your team uses the service under your account and your responsibility.
2. The service
Stagyo produces virtual home staging: from a photograph of a room you upload, an artificial-intelligence model generates a new image in which the room is furnished and decorated in the style you choose. The service also includes a lightweight property record, team accounts, branded presentation pages and share links, and everything else described on the site at the time you use it.
The images are produced by a generative model. That has two consequences you accept when you use the service: the result is not deterministic (two generations from the same photo will differ, and neither can be reproduced exactly), and the model can make mistakes — a window in the wrong place, a piece of furniture that would not fit, a colour that is not the one you asked for. We do our best to keep quality high and we re-credit generations that fail technically (see clause 4), but we do not promise that any given image will meet your expectations.
We improve the service continuously and may add, change or withdraw features, styles or quality tiers. If a change materially reduces what you have paid for, we will tell you in advance, and you may cancel and be refunded for the unused part (clause 5).
3. Your account
You must be at least 18 years old to open an account. You agree to give us accurate information, to keep your password confidential, and to tell us promptly at the address above if you believe your account has been used without your authorisation. Everything done with your credentials is treated as done by you.
The welcome credits are offered once per person and per organisation. Creating several accounts to obtain them repeatedly, or using disposable addresses to do so, is a breach of these Terms and lets us close the accounts concerned and cancel the credits.
4. Credits, plans and payment
The service is paid for in credits. Each generation consumes a number of credits that depends on the quality tier you select; that number is shown in the studio before you confirm. Credits are bought either as a one-off pack or through a monthly subscription that grants a fixed number of credits each period. Prices, pack sizes and what each plan includes are those displayed on the billing page at the time of purchase; we may change them for future purchases, never for one already paid.
- Packs do not expire while your account is open.
- Subscription credits that you do not use in a period roll over for up to three months, then lapse. A subscription renews automatically at the end of each period until you cancel. You may cancel at any time from the billing page; cancellation takes effect at the end of the period already paid, and no further payment is taken. Upgrades apply immediately; downgrades apply at the next renewal.
- If we increase the price of a subscription you hold, we will give you at least 30 days' notice by e-mail before the new price applies, and you may cancel before it does.
- A generation that fails for a technical reason on our side, or that returns no image, is automatically re-credited. An image that was produced but that you do not like is not: you are paying for a generation, not for a particular result. Use the free welcome credits to check that the service suits you before buying.
- Credits are personal to your account and cannot be transferred, resold or exchanged for money, except as provided in clause 5.
Payments are processed by Stripe. Your card details are entered on Stripe's pages and never reach our servers. Prices are shown in euros; whether VAT is included is stated next to each price. Business customers within the EU who provide a valid VAT number are invoiced under the reverse-charge mechanism where it applies. If a payment fails or is reversed, we may suspend the paid features of the account until it is settled.
5. Refunds and the right to withdraw
Our refund guarantee, for every customer. If you change your mind within 7 days of a purchase and have not used any of the credits it granted, write to us and we will refund it in full. If some of the credits have been used, we refund the unused part of a pack in proportion. Subscriptions are refunded in the same way for the current period only; past periods are not refundable.
Consumers: your statutory right to withdraw. If you are a consumer, the law gives you 14 days from a purchase to withdraw from it without giving a reason. Because credits are a digital service that begins as soon as you spend them, by spending a credit within those 14 days you expressly ask us to start performing the contract immediately and acknowledge that, for the credits used, the right to withdraw is lost; you remain entitled to withdraw for the unused credits and to be refunded for them. To withdraw, send us a clear statement by e-mail (a simple message saying that you withdraw is enough). We refund within 14 days of receiving it, by the same means of payment.
Refunds are made to the payment method used for the purchase. Welcome credits and any other credits granted free of charge have no cash value and are never refunded.
6. Your photographs and data
You keep all rights in the photographs, texts and property information you upload (“your content”). You grant us the non-exclusive, worldwide licence that is strictly necessary to provide the service: to store your content, to send the photographs to the generation model, to produce the images, and to display them to you and to the people you share them with. This licence ends when you delete the content or your account, subject to the retention periods stated in our privacy policy. We do not use your content to train a model, in our own marketing, or for any purpose other than serving you.
You confirm that you have the right to upload your content and to have it transformed as the service does — in particular that you hold or have obtained the rights in each photograph, and any authorisation needed from the owner or occupant of the property. You are responsible for what you upload, and you will compensate us for any claim by a third party arising from it.
7. The generated images and how you may use them
Subject to payment and to these Terms, the images generated from your content are yours: you may use them in listings, presentations, brochures, on portals and social networks, and in your communication with clients, without limit of time or territory. We claim no right in them beyond the ones needed to show them on the presentation pages and share links you create, for as long as you keep those active. Applicable law may limit the copyright that can exist in AI-generated images; we make no promise about that and grant you everything we are able to grant.
What the images are, and are not. A generated image is a representation of virtual furnishing, produced by software. It does not show the property as it is at the moment of sale or rental, it may contain approximations, and it is not a survey, a description of the property, a floor plan or a contractual document of any kind.
Your obligations when you publish them. Consumer-protection and real-estate advertising rules in most countries prohibit presentations that could mislead a buyer or tenant. You therefore undertake to:
- state clearly, wherever a generated image is published, that it is virtual staging or a computer-generated visualisation (for instance “virtually staged” or “photo non contractuelle — home staging virtuel”);
- use the images only to illustrate how a room could be furnished, never to conceal a defect, to alter the structure, dimensions, view, condition or fittings of the property, or to represent as real something that does not exist;
- keep the original photograph available to anyone who asks for it;
- comply with the advertising, consumer and property laws of every country in which you publish the images.
You alone are responsible for the use you make of the images and for the claims of your clients, buyers or tenants about them. Generated images may carry an invisible watermark added by the model provider to identify them as AI-generated; you agree not to remove it.
8. Acceptable use
You agree not to:
- upload content that you do not have the right to use, that is unlawful, or that shows identifiable people without their consent;
- use the service to produce misleading, defamatory, obscene or hateful images, or images intended to deceive anyone about a property, a person or an event;
- attempt to gain access to another account or to data that is not yours, probe or overload our systems, or circumvent a limit, a queue or a price;
- copy, scrape, resell or offer the service itself to third parties as your own, or reverse-engineer it — sharing the images and presentation pages with your own clients, including under your own branding, is of course allowed and is what the service is for;
- use automated means to create accounts or to obtain free credits.
9. Share links and presentation pages
Share links and presentation pages are public to anyone who has the address (and the password, if you set one). You decide what they show, you can revoke them at any time, and you are responsible for what you publish through them, including under your own branding. We may disable a link that is used in breach of these Terms.
10. Third-party services
Image generation relies on a model operated by Google (the Gemini API), and payments on Stripe. We choose these providers with care and bind them by contract, but we do not control them. An outage or a change on their side may temporarily affect the service; when it does, clause 4 on re-crediting failed generations applies.
11. Availability and support
We aim to keep the service available at all times, but we do not guarantee uninterrupted access: maintenance, updates, provider outages and events beyond our control can interrupt it. We will try to schedule maintenance outside business hours and to warn you of it. Support is provided by e-mail at the address above, in English and French, on business days.
12. Suspension and termination
By you. You may stop using the service and close your account at any time by writing to us. Closing the account deletes your content and generated images after the retention period stated in the privacy policy, and forfeits any remaining credits except those refundable under clause 5. Download what you want to keep first.
By us. We may suspend or close an account, with notice where practicable, if you seriously or repeatedly breach these Terms, if a payment remains unpaid after a reminder, if we are required to by law, or if the account has been inactive for more than 24 months. In the case of a breach, the remaining credits are forfeited; in every other case we refund the unused credits. We may also stop offering the service altogether, with at least 60 days' notice, in which case unused credits are refunded.
13. Our intellectual property
The service, its software, design, name, logo, texts, prompts, catalogues of styles and rooms, and documentation are ours or licensed to us, and are protected by intellectual-property law. These Terms give you a personal, non-exclusive, non-transferable right to use the service; they transfer nothing else. Feedback you send us may be used to improve the service without obligation to you.
14. Liability
What we do not exclude. Nothing in these Terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that the law does not allow us to limit or exclude. If you are a consumer, nothing here affects your statutory rights, including your right to a service performed with reasonable care and skill.
For every customer. We are not responsible for the way you use the generated images, for the accuracy of what they show, for the decisions that a buyer, tenant or client takes on the basis of them, or for your compliance with the advertising and property laws that apply to you. We are not responsible for losses caused by events outside our reasonable control, by a third-party provider, or by your breach of these Terms.
For business customers only. We are not liable for any loss of profit, revenue, business, contracts, goodwill or data, or for any indirect or consequential loss, however it arises. Our total liability to you under or in connection with the service, whether in contract, tort (including negligence) or otherwise, is limited, for all claims together, to the amount you paid us in the twelve months preceding the event giving rise to the claim. The service is provided “as is” and, to the extent the law permits, without any warranty other than those expressly stated in these Terms.
Indemnity (business customers). You will indemnify us against any claim, loss or cost, including reasonable legal fees, arising from your content, from the use you or your clients make of the generated images, or from your breach of these Terms.
15. Personal data
How we handle personal data is described in our privacy policy, which forms part of these Terms. For the data of your own clients and of the properties you manage — which you decide to enter in the service — you are the controller and we act as your processor; the processor terms in the privacy policy apply, and we will sign a separate data-processing agreement on request.
16. Changes to these Terms
We may update these Terms to reflect changes in the service, in the law or in our business. If a change is material, we will notify you by e-mail or in the application at least 30 days before it takes effect. If you do not accept it, you may close your account before that date and be refunded for the unused credits; continuing to use the service after that date means you accept the new Terms. The date of the current version is shown at the foot of this page.
17. Governing law and disputes
These Terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere, you also benefit from the mandatory consumer-protection rules of the country where you live, and nothing in this clause deprives you of them.
If you have a complaint, write to us first: most issues are settled within a few days. Failing an amicable solution, the courts of England and Wales have jurisdiction, except that a consumer may also bring proceedings in the courts of the country where they live, and we will only bring proceedings against a consumer there. We are not obliged to, and do not, take part in alternative dispute resolution schemes.
18. General
These Terms, the privacy policy and the prices displayed at the time of purchase are the whole agreement between us about the service. If a clause is found invalid, the rest remains in force. If we do not enforce a clause at some point, we may still do so later. We may transfer this contract to a successor that takes over the service, telling you of it; you may not transfer your account without our consent. Notices to you are sent to the e-mail address of your account. These Terms are written in English and translated for convenience; the English text governs in case of discrepancy.
